If you are interested in Delray Zoning laws our attorneys are ready to answer your questions. Whether you are a business, homeowner, or property developer, a land use and zoning lawyer can help challenge a municipality’s zoning regulation and land use restriction. We are located in historic Downtown Delray Beach, Weiner, Lynne & Thompson, P.A. has provided exceptional legal representation to residential and commercial real estate developers, lenders, landlords and tenants.

Florida law , which affects Delray Zoning, allows zoning boards and agencies to implement zoning regulations in accordance to a comprehensive plan. These plans are designed to provide a description of the local guidelines, goals, principals, and standards the community wants to implement to maintain economic, social, physical and environmental development. These comprehensive plans must be created and changed through the local panning agency, which must hold public hearings on the plan to allow the public a chance to have input.

The purchase and sale of real estate should be handled by an attorney representing your interests. Before land is purchased or development occurs, an effective real estate attorney should work with you to review title and obtain title insurance, obtain environmental due diligence of the land and the building, determine whether there needs to be compliance with the Americans with Disabilities Act (ADA), and whether the land, structures, and use of the property conform to zoning regulations in effect at the time of purchase or sale. Your real estate attorney should also be well-versed in the financing of real estate transactions and the real estate tax consequences. When a deal falls apart, there can sometimes be real estate litigation that occurs, and an attorney well-versed in all aspects of real estate law, trial experience, and corporate and business affairs is essential.

Zoning is a system of land use controls exercised by the government, often through the permitting process. It is intended to regulate the use of land and to mitigate the impacts of land development upon adjacent and surrounding uses. Zoning regulation and zoning ordinances fall under the police power rights that local governments such as Boca Raton, Delray Beach, Boynton Beach, Lake Worth, West Palm Beach, and Palm Beach County, may exercise over real property, such as the location and design of privately constructed office buildings, retail centers, historic buildings, and residential and commercial developments. The police power exercised by cities and other government agencies often comes into conflict with private property rights guaranteed by the United States Constitution and the Florida Constitution, as well as civil liberties provided by state and federal law intended to protect people such as those with addiction disabilities from discrimination in housing.

Weiner, Lynne & Thompson, P.A. solves their clients’ local government regulation issues throughout Palm Beach County including Boca Raton, Delray Beach, Boynton Beach, Lake Worth, and West Palm Beach. While the current use of the word “lobbyist” has become synonymous with representation of special interests, professional lobbyists are hired to identify the specific issues of their clients’ concern which require representation before and resolution with the government. Lobbyists understand the framework in which local governments operate and are therefore in the best position to facilitate cooperative dialogue between business and private property owners and the government to obtain relief from otherwise burdensome overregulation. A lawyer lobbyist is uniquely positioned to protect clients’ legal rights while also facilitating an economically viable and efficient resolution.
